Terms and Conditions of Use

1. Acceptance of conditions

By accessing and using KmrShop (hereinafter "the Platform"), you agree to be bound by these Terms and Conditions of Use (hereinafter "the Conditions"). If you do not agree to these Conditions, please do not use the Platform.

KmrShop reserves the right to modify these Conditions at any time. Modifications will take effect immediately upon publication on the Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the new Conditions.

2. Description of service

KmrShop is an online marketplace that connects sellers and buyers. The Platform allows sellers to create their virtual shops and sell their products, and buyers to discover and buy these products.

KmrShop acts only as an intermediary and is not a party to transactions between sellers and buyers. We are not responsible for the quality, safety, legality or accuracy of the listed products.

3. Registration and user account

3.1 Eligibility

To use KmrShop, you must be at least 18 years old and have the legal capacity to enter into binding contracts. By creating an account, you declare that you have the required age and capacity.

3.2 Account information

• You must provide accurate, complete and up-to-date information during your registration
• You are responsible for the confidentiality of your password
• You are responsible for all activities performed from your account
• You must inform us immediately of any unauthorized use of your account
• You cannot transfer or sell your account to a third party

3.3 Suspension and termination

KmrShop reserves the right to suspend or terminate your account at any time, without notice, in case of violation of these Conditions, fraudulent activity or for any other reason deemed necessary.

4. Seller obligations

4.1 Shop creation

Sellers must:

• Provide accurate and complete information about their shop
• Configure at least one delivery zone before being able to receive orders
• Maintain their contact information up to date
• Respect all applicable laws and regulations

4.2 Listed products

Sellers agree to:

• Provide accurate and complete product descriptions
• Use authentic and representative images of the products
• Indicate fair and clearly displayed prices in XAF
• Not sell illegal, counterfeit, dangerous or prohibited products
• Respect intellectual property rights
• Maintain sufficient stock or remove unavailable products

4.3 Order processing

• Process orders within the announced timeframes (maximum 48h)
• Pack products securely
• Ship orders according to agreed methods and timeframes
• Update order status in real time
• Provide quality customer service to buyers

4.4 Prohibited products

It is strictly forbidden to sell:

• Weapons, ammunition and explosives
• Drugs and illicit substances
• Counterfeit or pirated products
• Stolen items or items of doubtful origin
• Violent, hateful or pornographic content
• Medicines without valid prescription
• Falsified identity or financial documents
• Dangerous products without required certifications

5. Buyer obligations

• Provide accurate and complete delivery information
• Perform payment within the allotted time
• Verify products upon receipt
• Contact the seller in case of problem before opening a dispute
• Do not abuse the dispute or refund system
• Leave honest and constructive reviews
• Respect sellers and other users

6. Payments and fees

6.1 Platform fees

KmrShop takes a 5% commission on each successful sale. This commission is automatically deducted from the amount paid to the seller.

6.2 Payment methods

Buyers can pay via mobile money, bank cards, or other available methods. Sellers receive their payments after delivery confirmation, minus the commission.

6.3 Refunds

Refunds are managed on a case-by-case basis according to sellers' return policies and our general conditions. Transaction fees may not be refundable.

7. Delivery and shipping

• Sellers are responsible for product shipping and delivery
• Delivery times are indicative and not guaranteed
• Shipping fees are clearly indicated before order finalization
• Risks are transferred to the buyer upon delivery
• In case of loss or damage during transport, contact the seller and/or carrier

8. Returns and disputes

8.1 Return policy

Buyers generally have 7 days to return a non-compliant or defective product. Specific conditions vary according to the seller's policy. Return fees may be the responsibility of the buyer or seller as the case may be.

8.2 Dispute resolution

In case of dispute between buyer and seller, you must first attempt to resolve the issue directly with the other party. If no solution is found, you can open an official dispute via the Platform. Our team will review the case and render a decision within 48-72 hours.

9. Intellectual property

All Platform content (logo, brands, texts, graphics, design, source code) are the property of KmrShop or its licensors and are protected by intellectual property laws.

By publishing content on KmrShop (images, descriptions, reviews), you grant KmrShop a worldwide, non-exclusive, royalty-free license to use, reproduce, modify and display this content in the context of our services.

You remain the owner of your content and guarantee having all necessary rights to publish it on the Platform.

10. Limitation of liability

To the maximum extent permitted by law, KmrShop will not be responsible for:

• The quality, safety, legality or accuracy of sold products
• Actions or omissions of sellers or buyers
• Loss of profits, revenue or data
• Indirect, special or consequential damages
• Service interruptions or technical errors
• Losses resulting from viruses, malwares or cyberattacks

Our total liability to you will under no circumstances exceed the amount of fees you have paid to KmrShop during the last 12 months.

11. Indemnification

You agree to indemnify, defend and hold harmless KmrShop, its officers, employees and partners from any claim, loss, liability, damage, cost or expense (including reasonable attorney fees) arising from:

• Your violation of these Conditions
• Your violation of third party rights
• Your use of the Platform
• The content you publish on the Platform

12. User behavior

You agree NOT to:

• Use the Platform for illegal or fraudulent purposes
• Harass, threaten or abuse other users
• Publish offensive, defamatory or inappropriate content
• Violate intellectual property rights
• Circumvent Platform security systems
• Use robots, scrapers or automated tools
• Create fake accounts or impersonate others
• Manipulate reviews, ratings or rankings
• Spam or unsolicited solicitation

13. Applicable law and jurisdiction

These Conditions are governed by the laws in force in the country of establishment of KmrShop. Any dispute relating to these Conditions will be subject to the exclusive jurisdiction of the competent courts of that country.

14. General provisions

14.1 Severability

If any provision of these Conditions is found to be invalid or unenforceable, the remaining provisions will remain in effect.

14.2 Waiver

KmrShop's failure to exercise or enforce any right provided by these Conditions does not constitute a waiver of that right.

14.3 Entire agreement

These Conditions constitute the entire agreement between you and KmrShop regarding the use of the Platform and replace all prior agreements.
